Are payday loan legal in Minnesota?

Yes. Payday loans in Minnesota are legal and governed by Minnesota Statutes 47.60 et seq., which requires all payday loan providers to be registered and comply with the payday lending laws described below.

Minnesota payday loan legislation was introduced in 1995. Those laws have not changed significantly, since that time.

In the state, payday loans are officially known as “consumer small loans” and “consumer short-term loans”. Actually, these are two different loan types that are governed by different laws.

  • Minnesota Statutes Section 47.60 (as of 1995) governs consumer small loans not exceeding $350.
  • Minnesota Statutes Section 47.601 (as of 2009) governs consumer short-term loans up to $1,000.
